About These Terms
These Terms of Service apply when you use our website or purchase products and services from McMichaels.
By placing an order, you agree to these terms, subject to your statutory consumer rights.
These terms primarily concern purchases made by consumers for personal use. Different terms may apply to business purchases where separately agreed.
Nothing in these terms excludes or restricts rights that cannot lawfully be excluded under UK consumer legislation.
Products and Product Information
We make reasonable efforts to ensure that product descriptions, specifications, images, prices and availability information are accurate.
Product images are illustrative. Minor differences may occur between images and supplied products, provided the goods remain as described and meet applicable legal requirements.
Manufacturers may change product specifications. Where a material change affects your order, we will explain the change and provide an appropriate resolution.
Prices and Payment
All website prices are displayed in pounds sterling and include VAT where applicable.
Delivery, installation, recycling and other optional service charges are shown separately where applicable.
The total payable will be displayed before you place your order.
Payment must be made using an accepted checkout payment method.
If we discover a pricing error before accepting your order, we may contact you to offer the opportunity to purchase at the correct price or cancel.
We will not increase the agreed price without your consent.
Placing an Order
Placing an order constitutes an offer to purchase the selected goods or services.
An automated order acknowledgement confirms receipt of your order but does not necessarily constitute acceptance.
A contract is formed when we expressly accept your order, normally through an order acceptance or dispatch confirmation.
We may decline an order before acceptance for legitimate reasons, including stock unavailability, pricing errors, payment issues or delivery restrictions.
If payment has been taken for an order we cannot accept, we will provide a full refund.
Product Availability
Product availability depends on stock held at our stores, warehouses and suppliers.
Some products may need to be ordered from manufacturers or distributors.
Estimated availability dates are provided in good faith.
If a product becomes unavailable, we will contact you to discuss an alternative, revised delivery date or cancellation and refund.
Your statutory delivery and cancellation rights remain unaffected.
Delivery and Shipping
McMichaels offers delivery options according to product type and destination.
Local Delivery
We operate our own delivery vehicles and installation teams within our designated local delivery area, generally covering approximately 20 miles from Alloa.
Larger televisions and domestic appliances are normally delivered through this service.
Free standard local delivery is available on qualifying orders of £100 or more.
National Courier Delivery
Selected smaller products may be delivered nationally by courier, subject to applicable weight, size and destination restrictions.
Large domestic appliances and televisions larger than 50 inches are not normally eligible for national courier delivery.
Available delivery options and charges are displayed at checkout.
Delivery Dates
Customers may select a preferred delivery date where this service is available.
Delivery dates depend on product availability, destination and any installation services required.
We will make reasonable efforts to deliver on the agreed date.
Unless otherwise agreed, goods must be delivered without undue delay and within 30 days of the contract being formed.
Responsibility for Goods
Where McMichaels arranges delivery, responsibility for the goods remains with us until they are received by you or a person nominated by you, subject to applicable law.
Further information is available in our Shipping & Delivery Policy.
Delivery Access and Customer Responsibilities
Customers must provide accurate delivery information and ensure that suitable access is available.
For larger appliances and televisions, please check doorways, hallways, staircases and other access restrictions before delivery.
Please notify us of circumstances that could make delivery difficult.
Our delivery team may decline work where conditions present an unreasonable safety risk.
Where delivery fails because of incorrect information, unsuitable access or customer absence, reasonable additional delivery charges may apply where legally permitted.
Any additional charge will be explained before it is incurred.
Installation Services
McMichaels offers optional installation services for selected products within our service area.
Services may include television installation, wall mounting, domestic appliance connection, removal and recycling.
Available services and charges will be confirmed before purchase.
Customers must ensure that existing electrical, plumbing and structural arrangements are suitable for the requested work.
Our installers may decline or suspend work where existing arrangements are unsafe or unsuitable.
Additional work and charges will be discussed and agreed before proceeding.
All installation services will be performed with reasonable care and skill in accordance with the Consumer Rights Act 2015.
Cancellation of Online Orders
Consumers purchasing goods online normally have the right to cancel without giving a reason within 14 days after receiving their goods.
Where goods are delivered separately, the cancellation period normally begins after receipt of the final item.
To cancel, you must clearly inform us of your decision before the cancellation period expires.
You then normally have a further 14 days to return the goods.
McMichaels also offers a voluntary 30-day change-of-mind returns period, subject to the additional conditions in our Returns & Refunds Policy. These conditions do not restrict statutory cancellation rights.
Certain goods and services are exempt from statutory cancellation rights where the relevant legal conditions apply.
Return Costs and Collection Charges
For eligible change-of-mind returns, customers are responsible for the direct cost of returning goods, where this responsibility has been disclosed before purchase.
Customers may arrange suitable return transport themselves or request collection by McMichaels where available.
Our standard collection charges within our local collection area are:
-
Small-item collection: £15
-
All large-item collection: £39, regardless of product size, including large televisions and American-style fridge freezers.
For returns outside our standard collection area, please contact us to discuss available arrangements and applicable costs.
Where goods cannot normally be returned by post, the applicable return cost or reasonable estimate must be disclosed before purchase.
These charges do not apply where McMichaels is legally responsible for return costs because goods are faulty or otherwise do not conform to the contract.
Installed Products and Uninstallation
Installation does not automatically remove statutory cancellation rights for goods purchased online.
Where customers return installed products because they have changed their mind, any required disconnection, uninstallation or removal work is a separate service.
Customers may arrange suitable uninstallation themselves or through an appropriately qualified professional.
Alternatively, McMichaels may provide an uninstallation service where available.
Any uninstallation charge will be quoted and agreed before work begins.
Where goods are faulty or otherwise do not conform to the contract, we will meet removal and associated costs where required by law.
Cancellation of Installation Services
For installation services purchased online, consumers normally have a 14-day cancellation period beginning when the service contract is formed.
If you request that installation begins during this period, we may require an express request for early commencement.
Where the service has been fully performed during the cancellation period, the statutory cancellation right may be lost if you expressly requested early commencement, acknowledged that the right would be lost upon full performance, and all applicable legal conditions have been satisfied.
Where these requirements are met, a completed installation service is not refundable solely because the customer subsequently changes their mind about the product.
If you cancel after installation work has started but before completion, a proportionate charge may apply where permitted by law and subject to the required information having been provided.
These conditions do not affect statutory remedies where installation work has not been carried out with reasonable care and skill.
Refunds
For valid statutory cancellations, refunds will be made in accordance with applicable consumer legislation.
This includes standard outbound delivery charges where legally required, but does not necessarily include additional charges for premium delivery services.
Refunds will normally be made using the original payment method.
Where goods are returned following statutory cancellation, we may withhold reimbursement until we receive the goods or evidence they have been sent back, whichever is earlier, subject to the applicable statutory rules.
A lawful deduction may apply where goods have been handled beyond what is necessary to establish their nature, characteristics and functioning.
We do not impose an automatic restocking fee on statutory cancellations.
Further information is available in our Returns & Refunds Policy.
Faulty, Damaged or Incorrect Goods
All goods supplied by McMichaels must comply with the Consumer Rights Act 2015.
Goods must be of satisfactory quality, fit for purpose and as described.
If goods are faulty or otherwise do not conform to the contract, you may be entitled to repair, replacement, price reduction or refund depending on the circumstances.
Consumers normally have a short-term right to reject qualifying faulty goods within 30 days.
Additional statutory remedies may apply after this period.
Where McMichaels is legally responsible, we will cover reasonable return and removal costs.
Your statutory rights are separate from any manufacturer warranty.
Manufacturer Warranties and Guarantees
Products may include manufacturer warranties, extended guarantees or promotional warranty arrangements.
Warranty duration, registration requirements and exclusions vary by product and manufacturer.
Where registration is required for an extended warranty, this will be explained in the relevant product information where available.
Manufacturer warranties provide additional protection and do not replace statutory rights against McMichaels.
Ownership of Goods
Ownership of purchased goods normally passes to you once payment has been received in full and the goods have been delivered, unless otherwise agreed.
This does not alter your statutory protections relating to responsibility for goods during delivery.
Website Use
You agree to use our website lawfully.
You must not attempt unauthorised access, interfere with website security, introduce malicious software or use our services for fraudulent or unlawful purposes.
We may take reasonable measures to protect our website, customers and business against misuse.
Intellectual Property
Website content, including text, design, graphics and other materials, is owned by McMichaels or used with permission from the relevant rights holders.
Manufacturer trademarks, logos and product images remain the property of their respective owners.
Content must not be reproduced commercially without appropriate permission, except where permitted by law.
Privacy and Personal Information
We process personal information in accordance with applicable UK data protection legislation.
Our Privacy Policy explains how we collect, use, store and share customer information.
Our website is powered by Shopify and uses third-party providers for functions including payment processing, delivery management and advertising.

Liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot legally be excluded.
Nothing in these terms restricts your statutory rights under the Consumer Rights Act 2015 or other applicable legislation.
We are responsible for losses that are a foreseeable consequence of our breach of contract or failure to exercise reasonable care and skill, subject to applicable law.
We do not exclude liability for damage caused by negligent installation work.
Events Outside Our Control
We are not responsible for delays caused by circumstances outside our reasonable control, such as severe weather, transport disruption or exceptional supplier interruptions, except where applicable law provides otherwise.
Where such circumstances affect an order, we will contact you and take reasonable steps to minimise disruption.
Your statutory cancellation, delivery and refund rights remain unaffected.
Complaints and Customer Support
We aim to resolve customer concerns promptly and fairly.
If you have a complaint concerning a product, delivery, installation or other service, please contact us.
We will investigate and work towards an appropriate resolution.
Governing Law
These Terms of Service are governed by Scots law.
Consumers residing elsewhere in the United Kingdom retain the benefit of mandatory consumer protections applicable in their place of residence.
Nothing in these terms removes any right to bring proceedings before a court with jurisdiction under applicable law.
Changes to These Terms
We may update these terms to reflect changes in legislation, business operations or website functionality.
The terms applicable to an order will generally be those in force when the contract was formed, unless a change is required by law or otherwise agreed.
The latest version will be available on our website.
